If you transport school pupils in Massachusetts in a van, station wagon, or car — not a full school bus — you operate a "7D vehicle" under M.G.L. c. 90, §7D. Here's exactly what your sign and lighting must look like, according to state law and 540 CMR 7.09.

1. What is a 7D Vehicle in Massachusetts?

Massachusetts General Laws Chapter 90, Section 7D allows school pupils to be transported in vehicles other than full-sized school buses. These smaller vehicles — typically vans, station wagons, or cars — are officially called school pupil transport vehicles, but everyone in the industry calls them 7D vehicles.

A 7D vehicle is restricted to carrying no more than 8 passengers in addition to the driver. If your vehicle can carry more than that, different rules apply.

The Law — M.G.L. c. 90, §7D The requirements of §7B (the full school bus standards) apply to any motor vehicle carrying not more than eight passengers in addition to the operator, used in the business of transporting school pupils for hire, whether under contract or otherwise. Note: the eight-lamp system required under §7B clause (7) does not apply to 7D vehicles.

The key distinction: a 7D vehicle is not a school bus. It does not require the same amber and red four-lamp warning system that full buses use. But it still requires a specific school bus sign, specific red flashing lamps, and a certified 7D driver. The penalties for non-compliance can include fines and — more practically — a failed semi-annual RMV inspection that takes your vehicle off the road.

2. Who These Requirements Apply To

These 7D rules apply whenever you are operating a non-school-bus vehicle to transport Massachusetts school pupils on a fixed route. If you're doing any of the following on a regular, predetermined basis for the length of a pupil's school year, you are a 7D operator:

What counts as a "school year"? Massachusetts law is broader than you might expect. The "pupil's school year" is whatever period the program is expected to run. A six-week summer program counts. A semester counts. Even a week-long program is treated as a pupil's school year for that week. If you're doing it on a regular basis, assume 7D rules apply.

A "school pupil" under Massachusetts law means any person enrolled in kindergarten through grade 12, enrolled for day care services, or enrolled in any special needs program under M.G.L. c. 71B. This includes private school students, not just public school pupils.

Important — 15-passenger vans are prohibited Since 1974, federal law (49 U.S.C. 30112) has prohibited selling or leasing new vehicles with capacity of more than 11 persons for transporting students to and from school unless the vehicle complies with Federal Motor Vehicle Safety Standards as a school bus. Massachusetts RMV policy prohibits registering new non-conforming vans with 12–15 permanent seats for pupil transportation. Do not attempt to operate a 15-passenger van as a 7D vehicle.

3. The School Bus Sign: Exact Specifications

Under 540 CMR 7.09(7) and M.G.L. c. 90 §7B (incorporated by reference into §7D), your vehicle must display a "School Bus" sign on both the front and rear. This is not optional, and the specifications are precise.

Why a folding sign is the right choice for 7D vehicles A folding school bus sign solves a real compliance problem: Massachusetts law requires you to display the sign when transporting pupils, but you must not display it when pupils are not aboard (to avoid misleading other motorists). A folding sign lets you raise it at the start of a route and fold it flat at the end — without removing and reinstalling anything. Sign placement on the vehicle

The sign must be clearly visible to oncoming traffic from both the front and rear. Under the federal guidelines incorporated by Massachusetts law, the "School Bus" lettering should be located between the warning signal lamps, as high on the vehicle as possible without impairing visibility of the lettering from front and rear. The sign must also be securely mounted so it will not shift, rattle loose, or become obscured at highway speeds.

Statutory Authority — M.G.L. c. 90, §7B(1) "The words 'SCHOOL BUS' shall be painted or otherwise displayed on the front and rear of each such vehicle in black letters of eight inches in height and conform to series 'B' of the standard alphabets for highway signs on a National School Bus Yellow background, or shall be so painted upon signs attached to the front and rear of each vehicle."

4. LED Signal Lamp Requirements (49 CFR 571.108)

This is where many 7D operators get confused. The eight-lamp system required on full school buses under M.G.L. c. 90 §7B clause (7) does not apply to 7D vehicles. However, 7D vehicles still have specific flashing lamp requirements under 540 CMR 7.09(7).

What 7D vehicles must have

Per 540 CMR 7.09(7), your 7D vehicle must comply with all applicable provisions of 49 CFR 571.108 (Federal Motor Vehicle Safety Standard No. 108 — Lamps, Reflective Devices, and Associated Equipment). This includes:

Mounting height and location

Federal standard 49 CFR 571.108 requires signal lamps to be positioned to maximize visibility above surrounding traffic. The lamps must be placed as high as practical on the vehicle to ensure they are visible to other motorists approaching from the front and rear. Precise photometric and placement requirements are specified in FMVSS 108 — your sign and lamp supplier should be familiar with these standards.

Do not activate school bus lights when pupils are NOT aboard The school bus signal lamps must only flash when pupils are entering or leaving the vehicle. Running your school bus lights at other times is a traffic violation under Massachusetts law and can confuse or endanger other motorists.

LED vs. incandescent: what Massachusetts allows

Massachusetts accepts LED signal lamps provided they comply with the photometric (light output) and performance requirements of 49 CFR 571.108. 5. Other Required Equipment on 7D Vehicles

The sign and lighting are the most visible requirements, but Massachusetts 7D regulations cover a broader range of vehicle equipment. Under M.G.L. c. 90 §7D and 540 CMR 7.09, your vehicle must also carry and maintain:

7. Massachusetts 7D Vehicle Inspections

7D vehicles in Massachusetts are subject to more than the standard annual state inspection. Under M.G.L. c. 90 §7D, all 7D vehicles are required to undergo a semi-annual safety inspection:

These inspections are conducted by RMV-approved inspection facilities. The inspector will verify all equipment under 540 CMR 7.09 — including your school bus sign, signal lamps, dashboard indicator, seatbelts, fire extinguisher, and all other required equipment. A vehicle that fails inspection receives a 7D Repair Form (EQ) and cannot legally transport pupils until the deficiency is corrected and re-inspected.

If you are a new 7D operator who has not previously registered a 7D vehicle, you must submit a Supplemental Registration Application before initial registration. An RMV field investigator will visit your location to inspect the vehicle and review your operating procedures before you can register.

8. Frequently Asked Questions

Do I need a 7D sign if I only transport one or two students?
Yes, if you are transporting school pupils for hire on a fixed route, the number of pupils does not exempt you from 7D requirements. Even transporting a single student on a regular daily basis for payment triggers the §7D obligations, including the sign, lamps, and 7D driver's certificate.
Can I use a magnetic sign instead of a bolted folding sign?
Massachusetts does not explicitly ban magnetic signs, but the RMV requires signs to be securely mounted. A magnetic sign that shifts or falls at highway speed would fail inspection. Most experienced 7D operators use a mechanically mounted folding sign that locks in both the upright and folded positions — this is the surest way to pass inspection and operate safely at highway speeds.
Does my 7D vehicle need the eight-lamp amber/red alternating system like a full school bus?
No. M.G.L. c. 90 §7D explicitly states that the eight-lamp system required under §7B clause (7) does not apply to 7D vehicles. You need front and rear alternating flashing red signal lamps compliant with 49 CFR 571.108, but not the full amber/red warning lamp system used on large school buses.
Do I need to display the school bus sign when driving my 7D vehicle empty?
No — and in fact you must not. When no school pupils are aboard, the school bus sign must be folded down, concealed, or removed. Driving with a raised school bus sign when not transporting students is misleading to other drivers and a violation of state law. A folding sign handles this automatically: raise it for the route, fold it at the end.
What is the fine for a 7D vehicle not displaying the proper sign?
Non-compliance with 7D vehicle equipment standards can result in fines and, more significantly, a failed semi-annual inspection that grounds your vehicle until deficiencies are corrected. Additionally, operating a 7D vehicle without meeting all §7D requirements exposes the operator and the school system or carrier to liability in the event of an incident.
